These Terms of Service apply to all transactions between the customer and Guéniat Gold Gallery relating to the provision of products and services. This includes quotations, contracts and variations.

Gueniat Gold Gallery may amend quote details in writing to the Customer. Any amendments supersede prior details agreed between the purchaser and seller.
About Us:
Guéniat Gold Gallery is an Australian fine jewellery brand offering a range of luxury jewellery, including curated and bespoke jewellery pieces for purchase online and, where applicable, through direct consultation.
Product Information:
Gueniat Gold Gallery takes great care in presenting jewellery pieces as accurately as possible, including product descriptions, imagery, dimensions, and materials. As each piece may be handmade, natural, or individually finished, slight variations in tone, texture, stone appearance, or measurement may occur. These are part of the character of fine jewellery and are not considered faults.
Pricing and Payment:
All prices are listed in Australian dollars unless otherwise stated.
Gueniat Gold Gallery reserves the right to amend pricing, product availability, and specifications at any time prior to acceptance of an order. Full payment, or any required deposit, must be received before an order is processed.
The Customer and Guéniat Gold Gallery agree to comply with their obligations in relation to Products and Services Tax (GST) under the Australian Products and Services Act 1999 and any other applicable legislation governing GST.
Quotes:
Gueniat Gold Galley may issue a written quote to the customer, once all required information has been provided by the client.
All quotes are valid for 30 days from date of issue.
Acceptance of the quote needs to be provided by the customer, in writing and deposit paid before work can commence on a piece.
Any estimates relating to timeframes, provided by Guéniat Gold Gallery are estimations only, are not a fixed time frame and are subject to change. Subject to any obligations in respect of consumer guarantees under the Australian Consumer Law, this estimate is not binding upon Guéniat Gold Gallery.
Orders:
The customer must review quotes and online orders carefully, including but not limited to, materials, and size. Any costs incurred by Guéniat Gold Gallery in reliance on incorrect or inadequate information provided by the customer, or in an order, may result in additional charges.
Once an order is placed, the customer will receive an order confirmation. Acceptance of the order occurs only when Gueniat Gold Gallery confirms the order and payment has been successfully received by the seller.
Once production on bespoke or customised pieces has commenced, changes may not be possible, or may result in revised pricing and extended lead times.
Gueniat Gold Gallery reserves the right to decline or cancel an order where necessary, including where a product is unavailable, pricing or product information is incorrect, payment cannot be verified, or we reasonably suspect fraudulent activity.
Placement of an order by the customer signifies acceptance by the customer if these Terms of Service
All deposits are non refundable or transferable.
Cancellation of an Order:
An event of default will be taken to have occurred in any of the following circumstances:

The Customer fails, or is claimed to have failed, to comply with these terms and conditions for any reason, including but not limited to non payment of any amount due, and does not rectify such failure within 14 days after receiving written notice from Guéniat Gold Gallery.

The Customer cancels an order.
If an event of default arising, and unless full payment has already been received by Guéniat Gold Gallery, Guéniat Gold Gallery reserves the right to:

bring these terms and conditions to an end

cancel any or all existing orders and any credit facilities provided to the customer

decline to supply further Products or Services to the customer

retain any payments already made by the customer in relation to Products or Services.
Without limiting any other rights available to Guéniat Gold Gallery, upon an event of default, all outstanding invoices will become immediately due and payable.
An order cannot be cancelled without prior written consent from Guéniat Gold Gallery. Where an order is cancelled, the customer indemnifies Guéniat Gold Gallery against any losses incurred by Guéniat Gold Gallery as a result of the cancellation .
Care and Wear:
Fine jewellery should be handled with care according to our care instructions provided in the product descriptions. General guidance on caring for jewellery is also available on this site. Normal wear, accidental damage, impact, misuse, exposure to chemicals, improper storage, or unauthorised repair may affect the condition of a piece and may not be treated as a manufacturing fault.
Magnetique pieces which have come into contact with liquid or moisture will not be covered as a manufacturing fault.
Gueniat Gold Gallery recommends against wearing magnetic pieces by any person with an electrical medical device, including a pacemaker.
Acceptance of Products:
It is the customers obligation to advise Guéniat Gold Gallery in writing, within 24 hrs of delivery, if there is any fault in the product or failure of the product, in accordance with the customer’s order. If written notice from the customer is not received by Guéniat Gold Gallery within 24 hrs of delivery of a product, the customer is deemed to have accepted the product/s as not faulty and in accordance with with their order. Nothing in this paragraph affects the Customer’s rights for any alleged failure of a guarantee under the Australian Consumer Law.
Risk in products passes to the customer immediately upon delivery.
Property and title in products supplied to the customer under these Terms of Service does not pass to the customer until all monies due and payable to Guéniat Gold Gallery have been paid in full.
Refunds:
Items ordered cannot be returned, refunded or exchanged other than as provided for under the Terms of Australian Consumer Laws.
Gift Cards & Store Credits:
Gift cards and store credits are non-transferrable and valid for 36 months from date of purchase.
Gift cards and store credits are non-exchangeable if lost or stolen.
Intellectual Property:
All content on this website, including text, imagery, branding, logos, design elements, and product photography, is owned by or licensed to Guéniat Gold Gallery and must not be reproduced, copied, adapted, or used without prior written consent.
For bespoke commissions, unless otherwise agreed in writing, all sketches, design concepts, renderings, and creative materials produced by Guéniat Gold Gallery remain the intellectual property of Guéniat Gold Gallery.
In regard to designs provided by the customer, the customer warrants that it owns all intellectual property rights pertaining to the piece, or has license to authorise Guéniat Gold Gallery to reproduce the piece/s for the purpose of the order. In addition, the customer indemnifies, and agrees to keep indemnified, Guéniat Gold Gallery against all losses incurred by Guéniat Gold Gallery in relation to, or in any way directly or indirectly connected with any breach of any other intellectual property rights in relation to any material provided by the customer.
Warranty, Exclusions & Limitation of Liability:
All information, photos, specifications and samples provided by Guéniat Gold Gallery in relation to its products and services are approximations only and, subject to any guarantees under the Australian Consumer Laws. Small deviations or slight variations which do not significantly affect the customer’s use of the product/s will not entitle the customer to reject the product/s upon delivery, or to make any claim in respect to them.
Gueniat Gold Gallery offers a 6 month warranty during which it warrants that the product/s shall be free from defective workmanship and materials, other than fair wear and tear. Any products considered by Guéniat Gold Gallery to be defective within this warranty period will be repaired or replaced at the discretion of Guéniat Gold Gallery, unless such defects arose from misuse, not following product care guidelines as outlined on this site, incorrect adjustment or alterations by third parties.
If circumstances beyond the control of Guéniat Gold Gallery prevent or hinder its provision of the products or services, Guéniat Gold Gallery is free from any obligation to provide the product or service while those circumstances continue. Such circumstances may include, but are not limited to, strikes, lockouts, war, natural disasters, acts of God, government decrees, transport limitations and technological issues.
Website Use:
The customer agrees not to misuse this website, interfere with its operation, attempt unauthorized access, or use any content from the site for unlawful or commercial purposes without permission.
Gueniat Gold Gallery may suspend or restrict access to the website where reasonably necessary for maintenance, security, or operational reasons.
Privacy:
The customer’s personal information is handled in accordance with Gueniat Gold Gallery Privacy Policy also outlined on this site.
Miscellaneous Items:
These Terms of Service are governed by the laws of Queensland and each party submits to the non-exclusive jurisdiction of the courts in this state .
These Terms of Service supersede all oral and written negotiations and communications by and on behalf of either party.
If any provision of these Terms of Service at any time is, or becomes, void, voidable or unenforceable, the remaining provisions will continue to have full force and effect.
